Accidents at Work in Scotland
Everyone is worried about job security. At times like this, when companies are eager to make cuts and downsizing is on the cards for nearly every organization, many people are too afraid to rock the Boat, just in case your work is on the line. So if you have an accident at work and make a complaint, you can damage your career?
The power of fear!
The idea that making a claim against your employer for an injury suffered as a result of his negligence is a frightening prospect. No only the victim's concern of not being able to work for some time due to injury but there is also concern in the back of your mind that any legal action could lead to recriminations later.
However, the truth is that very few people experience harassment on site work or any other payment after making a legitimate claim for compensation. Employers understand that there is a right legal for workers to bring a compensation for an injury at work was the result of carelessness on the part of the company. Consequently, victimization is rare and under the Health and Safety (Act 1974) it is illegal to harass or intimidate an employee for any reason, including making a complaint.
Some victims also feel that there is some sort of social stigma attached to make a claim against an employer and automatically assume that your colleagues will see them as an opportunist, to make an "easy money" outside the employer's money to the poor, bound. Again, this does not is the case. A real genuine accident deserves compensation, and most claims made for accidents at work are made by people who suffered real pain and difficulties as a result.
Who actually handles your claim When you make a claim against an employer, is rarely the employer who actually pays the bill. Unless they let her slip of the indemnity insurance, the insurer is dealing with the claim, not the employer. If There was a clear case of negligence resulting in injury, the Health and Safety Executive (HSE) may take action against the company. But insofar as the request itself is concerned, is often the case that the employer has no real contact with his attorneys at all.
Most victims of accident compensation work find that their employers are, at best, extremely favorable for their actions and genuinely concerned for their welfare. A preventable accident is not is a stain on the victim character. It can act as a "wake up call 'for employers and highlights a real problem that resulted in a member of your organization suffering an injury. In bringing a claim, the victim is actually helping the employer to improve its duty of care to all employees and avoid the accident even happened to someone.
Making a complaint against an employer does not damage his career. It is designed to ensure that you receive the compensation you deserve from an injury that was not your fault. He also serves to highlight an unacceptable situation that the employer can then solve and protect other workers who suffer the same fate. While the claim is fair and justified, it can actually improve their work and those of his colleagues on a day to day basis – something that any decent employer would fight anyway.
